1. Agreement to Terms

By accessing or using Koyvu ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

2. Description of Service

Koyvu is a SaaS platform that provides automated Print-on-Demand workflow tools, including:

AI-powered design generation
Printify integration and automation
Design niche management
Workflow automation tools
Dashboard and analytics

3. Account Registration

To use our Service, you must:

Provide accurate and complete registration information
Maintain the security of your account credentials
Be at least 18 years old or have parental consent
Not share your account with others
Notify us immediately of any unauthorized access

4. Subscription and Payment

4.1 Subscription Plans: Our Service is offered on a subscription basis with various pricing tiers. Current pricing is available on our website.

4.2 Payment Processing: All payments are processed securely through Stripe. By subscribing, you authorize recurring charges.

4.3 Billing Cycle: Subscriptions are billed in advance on a monthly or annual basis, depending on your chosen plan.

4.4 Refunds: Refunds are handled on a case-by-case basis. Contact our support team at hello@koyvu.com for refund requests.

4.5 Cancellation: You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of the current billing period.

5. Acceptable Use

You agree not to:

Use the Service for any illegal purposes
Generate or distribute content that violates intellectual property rights
Create designs containing hate speech, violence, or explicit content
Attempt to hack, reverse engineer, or compromise the Service
Use automated tools to scrape or abuse the Service
Resell or redistribute access to the Service
Violate any third-party terms of service (including Printify's terms)

6. Intellectual Property

6.1 Service Content: The Service, including its original content, features, and functionality, is owned by Koyvu and is protected by international copyright, trademark, and other intellectual property laws.

6.2 User-Generated Content: You retain ownership of designs and content you create using the Service. By using the Service, you grant us a limited license to host, store, and process your content for the purpose of providing the Service.

6.3 AI-Generated Content: Designs generated using our AI tools are subject to the terms of the underlying AI service providers. You are responsible for ensuring compliance with their terms and obtaining necessary licenses.

7. Third-Party Services

Our Service integrates with third-party services including Printify. Your use of these services is subject to their respective terms of service and privacy policies. We are not responsible for the actions or policies of these third-party services.

8. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, available at /legal/datenschutz. We collect and process data as described in that policy.

9. Service Availability

We strive to provide reliable service but do not guarantee:

Uninterrupted or error-free operation
Specific uptime percentages
Availability of specific features
Compatibility with all third-party services

We reserve the right to modify, suspend, or discontinue any part of the Service with or without notice.

10. Limitation of Liability

To the maximum extent permitted by law:

Koyvu shall not be liable for any indirect, incidental, special, or consequential damages
Our total liability shall not exceed the amount you paid in the last 12 months
We are not responsible for losses resulting from third-party service failures
We do not guarantee the success or profitability of your Print-on-Demand business

11. Indemnification

You agree to indemnify and hold harmless Koyvu, its officers, directors, employees, and agents from any claims, damages, or expenses arising from:

Your use of the Service
Your violation of these Terms
Your violation of any third-party rights, including intellectual property rights
Content you create or distribute using the Service

12. Account Termination

We reserve the right to suspend or terminate your account if:

You violate these Terms
Your account shows suspicious or fraudulent activity
We are required to do so by law
You fail to pay subscription fees

Upon termination, your right to use the Service will immediately cease. We may delete your data after a reasonable grace period.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Service. Your continued use of the Service after changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Germany, without regard to its conflict of law provisions.

15. Dispute Resolution

Any disputes arising from these Terms or the Service shall be resolved through:

Good faith negotiations between the parties
If unsuccessful, through the courts of Germany

16. Severability
